The state filed a complaint against a Stanislaus County convalescent hospital over the deaths of two patients and an amputation required for a third patient. The Health Services Department filed suit in Superior Court in Modesto after Beverly Enterprises, owner of the Oakdale Convalescent Hospital, contested $115,000 in fines stemming from the three cases. Carlos Gilmore, 75, strangled last July 23 on chest restraints that had not been ordered by a doctor. An 82-year-old patient identified only as Howard J. died of cardiac arrest and gangrene after his condition deteriorated during a three-month stay. Arcadio Godinez, 77, lost his left leg below the knee to gangrene after a five-month stay.
