Confidential Drug Testing Merely NFL Lip Service?

Gene Upshaw, executive director of the NFL Players Assn., argues that mandatory random drug testing in the NFL would violate the Fourth Amendment, because the probable cause requirement would be violated. While probable cause is a requirement, the Fourth Amendment only applies to the government. Although some player contracts are reminiscent of the spending waste of the government, the NFL simply can’t qualify as Uncle Sam.
