Firm, Ex-Manager Fined Over Fatality

A Burbank electrical company was fined $12,750 and put on three years probation Tuesday after pleading no contest to state safety violations that resulted in the death of a worker in October.
In addition to fining All-Phase Electric Supply Co., Burbank Municipal Court Judge Alan Kalkin ordered Michael Edward Heary of Van Nuys, former operations manager at All-Phase, to pay a $5,100 fine. The judge also placed Heary on two years probation after Heary pleaded no contest to the same misdemeanor charge.
Heary was also ordered to perform 150 hours of community service and attend a seminar on industrial plant safety.
William Dale Nicholas, 60, a storage worker at All-Phase, died Oct. 16 after falling off a pallet hoisted nine feet by a forklift. The district attorney’s office said the company violated the state labor code by not installing a guardrail or a lifeline on the pallet.
